Article 1 (Definition of Personal Information)

In this Privacy Policy, “personal information” means personal information as defined in the Act on the Protection of Personal Information.

The Company handles names, addresses, telephone numbers, e-mail addresses, dates of birth, identity verification information, information relating to vehicles and construction equipment, transaction histories and other information that identifies an individual or is used in connection with a specific individual.

Article 2 (Acquisition of Personal Information)

The Company acquires personal information by lawful and fair means, within the scope necessary for its business. The principal means by which the Company acquires personal information are as follows.

1. Through the Company website, enquiry forms, telephone, e-mail and similar channels
2. Through transactions such as the appraisal, purchase, sale, import and export of motor vehicles, construction equipment and other goods
3. Directly from customers and other parties to a transaction
4. Through applications to services, campaigns and other activities conducted by the Company
5. By provision from a third party of lawfully acquired information
6. By any other proper method in accordance with laws and regulations

Article 3 (Purposes of Use)

The Company uses the personal information it acquires for the following purposes.

1. Appraisal, purchase, sale, import and export of motor vehicles, construction equipment and other goods, and associated operations
2. Responding to enquiries, consultations and requests from customers
3. Provision of goods and services, conclusion and performance of contracts, and transaction management
4. Identity verification, and the verification, recording and management required under the Secondhand Articles Dealer Act and other applicable laws
5. Settlement and reconciliation of purchase prices, sale prices and other payments arising from transactions
6. Transport, storage, customs clearance, registration, deregistration and other logistics, import and export procedures
7. Provision of information regarding the Company's goods, services and business
8. Improvement of the Company's services, goods and business, and the planning and development of new services
9. Analysis and improvement of the use of the Company website
10. Prevention of and response to fraud, unlawful conduct and other problems affecting the Company's operations
11. Response to requests from laws and regulations, administrative bodies, judicial bodies and other public authorities
12. Operations incidental or related to any of the above

Except where permitted by law, the Company does not use personal information beyond the scope necessary to achieve the purposes of use specified in advance.

Article 4 (Provision to Third Parties)

Except in the following cases, the Company does not provide personal data to third parties without obtaining the prior consent of the individual concerned.

1. Where required by laws or regulations
2. Where necessary to protect the life, body or property of a person and it is difficult to obtain the consent of the individual
3. Where particularly necessary to improve public health or promote the sound growth of children and it is difficult to obtain the consent of the individual
4. Where cooperation is necessary for a national body, a local government or a party commissioned by them to perform duties prescribed by law
5. In any other case permitted under the Act on the Protection of Personal Information or other applicable laws

Where the Company provides personal data to a third party, it carries out the verification, record-keeping and other measures required by law.

Article 5 (Provision to Third Parties Overseas)

In connection with the import and export of motor vehicles, construction equipment and other goods, overseas sales and other international business activities, the Company may provide personal data to third parties located outside Japan to the extent necessary. In such cases the Company acts in accordance with the Act on the Protection of Personal Information, other applicable laws and the guidelines issued by the Personal Information Protection Commission.

Where the consent of the individual is required for provision to a third party overseas, the Company obtains that consent after providing, in accordance with law, information on the personal information protection regime of the country concerned, the measures taken by the recipient and other information necessary for the individual to make a decision.

Where the handling of personal data is entrusted to a third party overseas, the Company likewise takes the necessary and appropriate measures in accordance with applicable law.

Article 6 (Outsourcing)

The Company may outsource all or part of its operations to external contractors. In such cases, taking into account the nature of the outsourced work and of the personal information handled, the Company requires the contractor to implement necessary and appropriate security control measures and exercises necessary and appropriate supervision. Contractors may include the following.

1. Website and system operation and management providers
2. Information processing and data management providers
3. Transport, logistics and customs clearance providers
4. Financial institutions and payment providers
5. Other providers necessary for the conduct of the Company's business

Article 7 (Security Control Measures)

The Company implements necessary and appropriate security control measures to prevent leakage, loss, damage, unauthorised access and other risks relating to personal information.

The Company also provides necessary and appropriate training and supervision to officers, employees and other parties who handle personal information. In the event of a leak or similar incident, the Company responds as required by applicable law.

Article 8 (Use of Cookies)

The Company website may use cookies and similar technologies in order to improve convenience for users, provide website functionality, analyse usage and improve services.

Information obtained through cookies may not include information that directly identifies an individual, such as a name, address or telephone number.

Users may restrict or disable cookies through their browser settings. In that case, however, some functions of the Company website may not operate correctly.

Article 9 (Access Analysis Tools)

Where an individual requests the disclosure, correction, addition, deletion, suspension of use, erasure or suspension of provision to third parties of their own personal information held by the Company, the Company responds appropriately in accordance with the Act on the Protection of Personal Information and other applicable laws.

The Company may ask for documents necessary to verify identity when such a request is made. Where there is no legal obligation to comply with a request for disclosure or similar, the Company may decline to do so.

The Company will review the content of the enquiry and respond appropriately in accordance with applicable law.

The Company may amend this Privacy Policy as necessary in response to changes in law, changes to its business, changes in how personal information is handled or otherwise.

The amended Privacy Policy will be published on the Company website or by other appropriate means.

The Company complies with the Act on the Protection of Personal Information and other laws and guidelines relating to personal information, and endeavours to manage and protect personal information appropriately.
